Please be advised that by replying #yesmartinelliluce on picture (“Picture”) after Martinelli Luce S.p.A. through its Instagram account martinelli_luce request on Instagram, you agree to the following terms:

- You provide Martinelli Luce S.p.A., an Italian company having its registered seat in via Teresa Bandettini 700, 55100 Lucca, Italy, VAT n. 00230590465 (“Martinelli Luce”) a non-exclusive, royalty-free, worldwide license to use, in any manner to be determined in its sole discretion and without any obligations to you, your Picture in its marketing and advertising channels such as: its website (martinelliluce.it, martinelliluce.com) and its social media accounts as well as in its newsletter, catalogues, magazines, brochures (all of them also intended to be printed in hard copy).

- The rights granted to Martinelli Luce include the right to reproduce, distribute, alter and edit your Picture, it being understood that your Picture will be always marked with your Instagram username so to be recognized as yours. You represent and warrant that: (i) you own the rights relevant to the Picture; (ii) you have permission from any person appearing in the Picture; (iii) you are at least 18 years old or have parental consent; (iv) the use of your Picture will not violate any rights of a third party or any law.

- Moreover, you undertake to release Martinelli Luce from all claims (including claims from third party), liabilities, irrespective of nature, in connection with the use of the Picture as described above. This terms and conditions are governed by the Italian law and for any dispute related and/or arising from them the Court of Lucca, Italy shall have exclusive jurisdiction.
